I have recently encountered several CDL license holders charged with DUI while driving a non-commercial vehicle. Navigating through the court system and MVA can be a minefield of problems and issues in an attempt to preserve the CDL.
MVA has become very aggressive in monitoring MVA hearings and it is critical that the record supports the Administrative Law Judge's finding or MVA is likely to appeal.
If you find yourself with this problem in Cecil, Kent, Queen Anne's or Harford Counties, please be sure you promptly speak with an attorney experienced in this area or you may find yourself mistakenly believing that a "PBJ" to TR 21-902(a) will save your CDL.
