DUI Penalties in Maryland

     Maryland's DUI/DWI statute has a 2 tiered level prohibiting driving while under the influence of alcohol or driving under the influence of alcohol per se (DUI) and driving while impaired by alcohol (DWI).  The statute also prohibits driving while impaired while under the influence of drugs or drugs and alcohol and driving while impaired by a controlled dangerous substance. The penalties range from 1 year in jail and/or a $1000. fine and 12 points to 60 days in jail and/or a $500. fine and 8 points.  Participation in an ignition interlock program may be required and alcohol and drug evaluation and treatment are routinely required.  Second and subsequent offenders face even harsher penalties. Convictions for out of state drivers will be reported to the drivers home state resulting in license suspension or revocation.

     Recent changes in the law have resulted in harsher administrative sanctions.  

  •      The penalty for test a test refusal or a BAC result .15+ is 270 days with no work license.
  •      Participation in an ignition interlock program may be an option for Maryland licensed drivers.   
  •      The penalty for a BAC result of .07 to .14 is a 6-month suspension; however, a work license is              possible

    You have only 10 days after your DUI arrest to request an administrative hearing with the Maryland Motor Vehicle Administration (MVA) regarding a proposed suspension due to the BAC result or for a test refusal.
