DUI Penalties in Maryland
Maryland's DUI/DWI statute involves 1) alcohol, 2) a combination of drugs and alcohol, and 3) controlled dangerous substances. The law prohibits driving while under the influence of alcohol, driving under the influence of alcohol per se (.08 +) and driving while impaired by alcohol. The statute also prohibits driving while impaired while under the influence of drugs or drugs and alcohol and driving while impaired by a controlled dangerous substance. The penalties range from 1 year in jail; $1000. fine and 12 points to 60 days in jail; a $500. fine and 8 points. Participation in an ignition interlock program may be required, and alcohol and drug evaluation and treatment are routinely required. Second and subsequent offenders face even harsher penalties. Convictions for out of state drivers are reported to the driver's home state resulting in license suspension or revocation.
Recent changes in the law have resulted in harsher administrative sanctions.
