DUI Penalties in Maryland

If you have been pulled over by a law enforcement agent and your blood alcohol concentration (BAC) is .07% or above, you will be charged with Driving While Impaired and/or Driving Under the Influence. Under Maryland law, if your BAC is .08 or above, you are "per se intoxicated" and you can be convicted. Some of the penalties that you could be subject to include the following for a first offense:

  • Drivers License Suspension
  • Fines of up to $1000
  • 8 to 12 points on your driver's license
  • Up to 1 year in jail
  • Alcohol treatment and classes

Second and subsequent offenders face even harsher penalties. Convictions for out of state drivers may be reported to the home state.

Additionally, with recent changes in the law with harsher administrative sanctions must act quickly. There are harsher penalties for test refusals. You only have 10 days after the date of your DUI arrest to request an administrative hearing with the Maryland Motor Vehicle Administration (MVA) regarding a proposed suspension due to the BAC result or for a test refusal. This hearing is not related to your criminal trial but will determine your future driving privileges. Do not forget that your Cecil County DUI lawyer can defend your right to drive in this MVA hearing. We have helped countless individuals retain their driving privileges through an aggressive and effective defense in their MVA hearings or an Ignition Interlock option.
