DUI Penalties in Maryland

If you have been pulled over by a law enforcement agent and your blood alcohol concentration (BAC) is .08% or above, you will be charged with DUI.  Under Maryland law, if your BAC is that level or above, you are "per se intoxicated" and you can be convicted.  Some of the penalties that you could be subject to include the following for a first offense:

  • Drivers license suspension for up to 60 days
  • 8 points on your license
  • Fines of up to $500
  • Up to 2 months in jail
